A&E Negligence Claims

Unfortunately, at some stage in our lives, we may need to attend an Accident and Emergency (A&E) department as urgent medical attention may be necessary due to sustaining a serious injury, whether in a car crash accident or the kitchen, stroke etc.

An A&E department has a duty to provide you with a standard of care which should be expected, but should you believe that has not happened, there may be a potential claim against the hospital for that failure which in turn may have caused you more harm.

If something goes wrong or you do not receive the standard of care you are entitled to expect when you visit an Accident and Emergency unit (A&E), you may be able to make a claim. This is known as a Clinical or Medical Negligence claim. To assist you, there are some examples below of what an A & E claim might be: 

  • Misdiagnosis or delayed diagnosis 

  • Failure to refer for further investigation or specialist input 

  • Failure to perform an adequate examination or take appropriate patient history 

  • Failure to act upon test results

A&E departments deal with a wide variety of medical problems, but the main source of A&E claims are:

  • Failure to properly diagnose a medical condition or problem or to do so within a reasonable time. The failure to diagnose on time can cause significant problems or deterioration for the patient over and above the initial injury that you came in for to the department.

  • Or the diagnosis is correct, but the wrong treatment or medication is given or provided incorrectly. A&E is the first point of contact with medical professionals, and something going wrong at this stage can fundamentally impact a patient.


Due to the pressures, there are also delays in being triaged in A&E. Ambulances are often left sitting outside for long periods, which may delay the start of treatment.
